Tailout Terms of Use
Effective: October 19, 2026
These terms are between you and Daddio Retro LLC, a Connecticut company ("we", "us"), the maker of Tailout. By playing Tailout you agree to them. If you got Tailout from the App Store, Apple's Licensed Application End User License Agreement also applies; if you got it on Steam, the Steam Subscriber Agreement also applies. Where they conflict with these terms about the store's own part (buying, refunds, the store account), theirs win.
1. Your licence
We give you a personal, non-exclusive, non-transferable licence to play Tailout on devices you own or control, as the store you bought it from allows. You may not resell, rent or redistribute the game, or reverse engineer it except where the law allows you to.
You may capture and share videos and pictures of yourself playing Tailout, including on channels that earn money.
2. Accounts and cloud saves
Cloud saves are optional. They use Unity's sign-in and may link to your Apple Game Center or Steam account (see our Privacy Policy). Keep your devices and platform accounts secure; anyone who can use them can use your basement. You can delete your cloud basement from the game at any time.
We try hard not to lose saves, but we don't promise cloud saves will always be available or never lose data.
3. Online play and the rules
When you race online, be decent. You may not:
- use a driver name, paint job or track that is offensive, hateful, sexual, harassing, threatening, or that shares someone's personal information;
- use a paint job or track you don't have the right to use (someone else's art, logos or trademarks);
- cheat: modify the game, its files or its network traffic to get an advantage, or exploit bugs on purpose;
- attack, overload or try to get into our servers or other players' devices;
- pretend to be us or another player.
Players can report names, paint jobs and tracks. We may remove anything that breaks these rules and stop an account from playing online, for a time or for good, at our discretion. If you think we got it wrong, write to us.
4. What you make
Tracks, paint jobs and driver names you make are yours. By using them in online play or cloud saves, you give us a worldwide, royalty-free licence to store, copy and show them to other players as the game needs, and to keep a copy when they are reported, for as long as needed to run the game and moderate it. We don't use them in Tailout's trailers, screenshots or store pages.
5. The game changes
We may update, change or remove parts of Tailout, including online play and cloud saves, and may shut down online services after giving reasonable notice in the game or on tailoutgame.com. Playing on your own device offline does not depend on our servers.
6. No warranty
Tailout is provided "as is". To the fullest extent the law allows, we make no promises that it will be free of bugs or always available. Nothing in these terms takes away rights you have under consumer law where you live that can't be taken away by a contract.
7. Limits on our liability
To the fullest extent the law allows, we are not liable for indirect or consequential losses, or lost data, and our total liability to you is limited to what you paid for Tailout. Some places don't allow these limits, so they may not apply to you.
8. Ending
You can stop playing at any time and delete your cloud basement. We may end your access to online services if you break these terms. Sections 4 (for content already shared), 6, 7 and 9 continue after that.
9. Law
These terms are governed by the laws of the State of Connecticut, USA, except where the law where you live says otherwise. Disputes go to the state or federal courts in Connecticut, unless the law where you live lets you bring them in your own courts.
10. Changes
If we change these terms, we will update the date at the top and, for meaningful changes, say so in the game or on tailoutgame.com. Playing after that means you accept the new terms.
